Prosecutors are seeking to try a 17-year-old as an adult after he was arrested and charged with murder in connection with a shooting at a Spirit Halloween store in Fairfield, California. The attack on November 2 left Constance Hages, 31, dead and six others wounded, according to Fairfield police.

The Solano County District Attorney’s Office has also charged the teen, identified as Monte Smith, with two counts of murder. Prosecutors stated they intend to argue that Smith should remain in custody due to the seriousness of the crimes and his alleged criminal record.

Smith had previously been arrested in another shooting incident that occurred in a high school parking lot in 2025. Following that arrest, he received a sentence and was later released, according to Fairfield police. Police Chief Dan Marshall expressed frustration, stating, "It’s time for change in California. I don’t know how many more people have to die at the hands of youth. Hopefully we’ve had plenty enough."

According to the DA's office, prosecutors pointed to Smith's alleged record, including a prior violent-offense conviction described as a "strike," in their decision to pursue an adult trial. The specific offense for the prior conviction was not detailed.

Constance Hages, who was pregnant at the time of the incident, was a mother of four. Her aunt, Clanisha Morton, organized a GoFundMe to help with funeral expenses and care for her children, describing the loss as creating an "overwhelming void."

Investigators believe Smith entered the Spirit Halloween store with the intention of targeting a specific customer. He allegedly opened fire, striking that individual and seven others. Hages died at the scene. The intended target has not been identified, nor has the motive for the shooting.

Smith reportedly fled the scene as law enforcement arrived. A school resource officer identified Smith as a former student by reviewing store surveillance footage, which led to his arrest within hours at a residence in Suisun City. The FBI assisted Fairfield police in processing the crime scene.

In addition to the murder charges, Smith faces three counts of attempted murder, three counts of assault with a semi-automatic weapon, and multiple gun enhancements. A multiple-murder special circumstance allegation was also filed. Smith's arraignment and detention hearing was scheduled for November 4.

Of the other victims, a 16-year-old boy, a 19-year-old man, and a 32-year-old man were reported in critical condition. A 23-year-old man was in critical but stable condition. Two other men, ages 19 and 43, were treated for their injuries and released.
