A former judge in Oklahoma is accused of firing a gun toward trick-or-treaters on Halloween night and then pointing the weapon at a police officer who responded to the scene. Jerry Herberger, 73, allegedly discharged his firearm outside his Duncan home around 8 p.m. on Saturday, according to police. No injuries were reported among the candy seekers.

When officers arrived, Herberger reportedly pointed his gun at one of them. He eventually complied with commands and was taken into custody without incident. He was subsequently booked into the Stephens County Jail, the same county where he formerly served as a judge. The Stephens County Sheriff’s Office confirmed his arrest.

Herberger has been charged with possession of a firearm while intoxicated and assault and battery with a deadly weapon, authorities said. The investigation into the incident is ongoing.
