Tony Romo's position as CBS Sports' lead NFL analyst is in flux following his arrest for operating while intoxicated (OWI) last month. CBS Sports President David Berson confirmed Tuesday that the network has not made a final decision on Romo's future and that "there is no timetable or final decision at this time."
Romo was placed on indefinite leave by CBS after being arrested by Milwaukee County Sheriff's Office deputies in Wisconsin. He was charged with OWI, having an open container of alcohol in his vehicle, and unsafe passing after exhibiting signs of impairment during field sobriety tests.
Berson addressed Romo's situation at "NFL on CBS" Media Day, explaining that the network is still assessing the situation. "It's an evolving situation and we are still assessing," Berson stated. He emphasized that Romo's situation is a "personal matter and a legal one" for the analyst.
When asked about Romo being placed on leave during the legal proceedings, Berson cited the importance of protecting the network's image and brand. "We have to consider the impact on our image and our brand," he said. "That's very important to us. The focus should be and needs to be on our presentation and this great product and not on any others."
CBS has named J.J. Watt as a top analyst alongside play-by-play announcer Jim Nantz for the 2026 NFL season. Berson also noted the network's confidence in its available talent, stating, "Fortunately, we have a deep bench and everybody is stepping up."
Romo is currently in the midst of a 10-year, $180 million contract with CBS, reportedly signed in 2020, with approximately $72 million still owed. Reports prior to his arrest had already raised questions about his long-term role as lead analyst beyond the 2026 season, the same year CBS is scheduled to broadcast the Super Bowl in 2028.
Industry insiders suggest Romo's contract contains a standard morals clause that CBS could potentially invoke to terminate his employment. However, any such action would likely face legal challenges from Romo's representatives, given the significant remaining value of his contract.
Romo's court date is scheduled for September 21, eight days before CBS Sports' first NFL broadcast of the upcoming season.
