A Washington state teacher accused of incest faces trial in October following her arrest in June. Amber Swain, 35, has pleaded not guilty to charges including incest and sexual misconduct with a minor. The allegations surfaced after her estranged husband reported suspicions to the Washington Department of Children Youth and Families.

New investigative files obtained by the Daily Mail reveal disturbing details, including alleged topless selfies of Swain, one taken in bed with her 17-year-old adopted son. Forensic analysis of Swain's phone reportedly uncovered photos of her sitting on the younger teen's lap while he kissed her cheek. Police interviews indicate the 17-year-old alleged that Swain had traded naked pictures with him. Screenshots of text messages suggest exchanges where they discussed sharing the same bed.

In one message exchange, the 17-year-old asked Swain if he could sleep in her bed. When he pressed for clarification on why not 'all night,' Swain allegedly responded, 'Because of what happened last time you slept with me.' The boy reportedly insisted 'nothing happened' and asked for 'just one more chance,' stating, 'I wanna cuddle.' Swain allegedly replied, 'I can't though [name]. I'm your mom. I don't feel that towards you.' After the boy pleaded 'just once,' Swain allegedly responded, 'No [name]. I love you so much. Nothing like that is ever going to happen.'

Swain's online search history allegedly included searches for 'forbidden love psychology' and 'missing someone intensely,' according to a police report. When confronted by investigators, Swain reportedly confessed that 'some of this is true, but a lot of it isn't.' She later stated she had been 'fighting the attraction.' A note found on her phone from March 2026 read: '[Victim] being inappropriate with me.' The documents also indicate Swain used ChatGPT to discuss her feelings, including conversations describing someone being 'inappropriate with her.'

According to one adopted son's account, he and Swain verbally confirmed they wanted to proceed before their first sexual encounter. He told police Swain took her own clothes off and described the relationship as 'fine, good' and that it 'doesn't feel wrong.'

A second adopted son told investigators he became suspicious after finding his brother's underwear on his bedroom floor and discovering the two in Swain's bedroom. He alleged that after drinking, he fell asleep in Swain's bed and woke to find her climbing in beside him. He described the encounter as 'things got handsy,' adding, 'It's just something that I thought I'd never do, with my mother obviously... Yeah, it's gross to think about.' He expressed disgust with himself and concern about his mother's alleged affair with his brother.

Swain's estranged husband, Daniel, filed the report with authorities on May 18, handing over text messages that helped build the case. Swain, a mother of six, was formerly a teacher and executive director of Spokane Angels, a nonprofit supporting foster children. She adopted one of the boys in 2017 after meeting him as a third-grader in her classroom. She and her husband adopted all three of their adopted sons in November 2019.

During interviews, one adopted son stated he had been having sex with Swain since December of the previous year, stating it had happened 'many times.' When confronted with this timeline, Swain reportedly said, 'I might have my timeline mixed up, but I don't know what to tell you.' Investigators stated they could not corroborate Swain's allegation that a second adopted son had sexually assaulted her. She later conceded she had not given police 'the full truth' about that incident, citing a lack of trust in systems.

Swain was booked on charges including incest in the first degree, incest in the second degree, and sexual misconduct with a minor in the first degree. If convicted, she faces up to ten years in prison. In the wake of her arrest, Swain was placed on administrative leave from Pend Oreille River School. Her lawyer did not respond to a request for comment. Search warrants for her Google account were issued in July, and the investigation is ongoing. Swain has also filed for divorce.
