Rep. Max Miller's ex-wife, Emily Moreno, has filed a lawsuit against the Ohio Republican, alleging that he and his lawyer "recklessly published and disclosed to the world a nude image" of their two-year-old daughter. The complaint, filed in federal court in Ohio, asserts that Miller and his attorney, Aaron Minc, violated federal laws regarding the "disclosure of intimate images" by sharing a link to an electronic Dropbox folder. This folder reportedly contained documents and a photograph of the child that depicted her genitalia.
Moreno's legal team stated that the child is an "innocent victim" and seeks $150,000 in liquidated damages for each download of the image, in addition to attorney fees and litigation costs. The exact number of downloads remains unclear.
Minc, Miller's attorney, previously acknowledged that an image of Moreno and Miller's daughter, described as having "her shirt off," was inadvertently included in the folder. However, Minc insisted that "there were no images of ‘genitals’" and stated that he takes "sole responsibility" for the contents of the folder, calling its inclusion "completely unintentional and a mistake."
Miller made the files public during an August 2 livestream on X, formerly Twitter, during which he denied allegations of abusing his ex-wife or their child. Moreno has previously accused Miller of physical abuse, including allegations of shoving, dumping hot water, and holding a gun to her head. A police report also details Moreno's concerns about their daughter's broken collarbone and a bruise on her shoulder.
Miller is currently under investigation by the House Ethics Committee. Calls for his resignation and withdrawal from his re-election bid have emerged following these allegations. Sen. Bernie Moreno (R-Ohio), the ex-wife's father, has called for Miller to seek psychological help, deeming him unfit for Congress.
