At a Fulton County Superior Court hearing Friday, a prosecutor alleged that Kroy Biermann Jr., 15, the teenage son of reality television personalities Kim Zolciak and Kroy Biermann, had filmed a sexual encounter with a family member under the age of 12.
Deputy District Attorney Caitlin McGillicuddy claimed that investigators found videos on KJ Biermann's phone depicting penetrative sex with a relative under 12. According to Page Six, McGillicuddy stated that this would be the second time Biermann has been charged with a serious sexual offense involving female victims. He is currently being held at Atlanta's Metro Regional Youth Detention Center following his August 17 arrest on seven felony charges stemming from an alleged sexual assault involving a female classmate in April.
KJ Biermann's attorney, Jason Sheffield, denied the prosecutor's assertions, stating that the characterizations of a prior juvenile matter grossly misrepresent the facts and its resolution. Sheffield explained that the previous case involved "inappropriate, crude behavior involving two middle-schoolers" and did not result in an adjudication for statutory rape or similar offenses.
McGillicuddy also informed the court that Biermann had been under court supervision since October 2025 for a prior charge of sexual battery of a victim under 16, which had not been previously made public due to it being handled in juvenile court. This supervision was in place for 10 months before his arrest on felony aggravated sodomy and felony aggravated sexual battery charges.
During the bond hearing, KJ's lawyer requested a $65,000 bond and suggested that Zolciak, who is currently unemployed and at home, monitor him. However, McGillicuddy countered by requesting a $190,000 bond, citing documented physical injury to the alleged victim in the April case and describing the incident as "predatory."
Judge Melynee Leftridge stated that she would rule on Biermann's bond by Monday. Court proceedings in the case will remain open to the public.
The teenager was indicted by a grand jury on seven felony charges, including aggravated child molestation, aggravated sodomy, aggravated sexual battery, three counts of sexual battery against a child under 16, and false imprisonment. These charges are related to an alleged encounter with a female classmate at a Life Time fitness center in Alpharetta, Georgia, on April 23. Biermann, who remains incarcerated, has denied all charges.
Sheffield has filed a motion to transfer the case to Georgia's juvenile justice system, arguing that Biermann, who was 14 at the time of the alleged assault, is young enough to be rehabilitated. He emphasized that the adult system carries a mandatory minimum sentence of 25 years, with no possibility of parole, and that Biermann "would not be eligible for parole at any point in that period."
Sheffield also requested that parts of the upcoming transfer hearing be closed and that juvenile records be sealed to protect the privacy of the minors involved and prevent potential harm from public dissemination of identities and conduct. He argued that the adult system focuses on punishment, while the juvenile system prioritizes rehabilitation and the child's developmental stage.
KJ's parents, Kim Zolciak and Kroy Biermann, were present at the hearing, despite being in the midst of a contentious divorce. They arrived separately and did not interact in the courtroom. Zolciak sat with their daughter Brielle Biermann, while Kroy appeared visibly stressed, according to an eyewitness.
Zolciak previously asserted KJ's innocence in a statement to the Daily Mail, calling the allegations "reckless and deeply troubling." She claimed her son passed a polygraph examination related to the accusations and that no DNA belonging to him was found.
According to court documents obtained by the Daily Mail, the alleged victim stated that the incident occurred in a family changing room at a gym. She claimed Biermann initiated unwanted contact and forced her to perform oral sex, also attempting to have sexual intercourse. An examination at North Fulton Hospital on April 24 reportedly found no evidence of male DNA. Police initiated an investigation in May, and Kroy Biermann Sr. was contacted on May 14.
