A New York City Department of Sanitation (DSNY) truck driver has been charged in connection with the death of a woman who was struck and killed while crossing a street in Bath Beach, Brooklyn. Timothy A. McVey, 41, was issued a desk appearance ticket on Wednesday, facing charges of failure to yield to a pedestrian and failure to exercise due care, according to police.
The incident occurred on the evening of Oct. 28. Siobhan Lynch, 30, was crossing at Bay Parkway and Cropsey Avenue when McVey, who was making a right turn, allegedly struck her. Police stated the impact threw Lynch onto the pavement, causing severe injuries. She was transported to NYU Langone Hospital-Brooklyn, where she later died.
McVey remained at the scene following the collision and was not immediately charged. The issuance of a desk appearance ticket means he will be required to appear in court at a later date.
Lynch's sister, Shannon, expressed shock at the nature of the charges, telling the New York Post, "It's shocking. The desk appearance ticket? It is very shocking the way this is being handled." She added that while she believes McVey did not intend to kill her sister, she expected more serious charges.
Shannon Lynch, who drives an ambulance, noted that drivers of large vehicles, including sanitation trucks, are aware of blind spots. She questioned McVey's haste, asking, "Where were you rushing to?"
Siobhan Lynch was a graphic and web designer who graduated from CUNY’s City Tech in 2022. Her sister described her as an animal advocate who fostered animals. Shannon Lynch posted a tribute on Facebook, calling her twin sister "gorgeous" and stating, "If only I knew it would be the last birthday we had together. I’m truly broken forever."
A spokesperson for the Department of Sanitation stated, "Given the ongoing nature of the case, we can’t say more other than to reiterate our prior statement that this is a terrible tragedy, and our thoughts are with the family of the victim. We will assist the NYPD in any way we can as the process continues."
