Nick Reiner, son of director Rob Reiner and photographer Michele Reiner, has been indicted on a murder charge that includes a special circumstance allegation of "lying in wait." This charge signifies a potential "surprise attack" on his parents, according to legal experts.
Celebrity criminal defense attorney Seth J. Zuckerman, who is not involved in the case, explained that "lying in wait" implies a concealment of intent and a period of watching and waiting before the alleged attack. This contrasts with premeditated murder, which requires proof of active planning and deliberation.
"There must be some evidence here, whether it's surveillance footage, text messages, witness testimony, a diary entry, or something that shows that he was lying and waiting for any plans to do this," Zuckerman stated. He added that this specific charge provides direct evidence of the defendant's state of mind.
Prosecutors believe this allegation could lead to harsher sentencing, potentially making the case eligible for the death penalty or life imprisonment without parole. However, California currently has a moratorium on the death penalty under Gov. Gavin Newsom.
Los Angeles County District Attorney Nathan J. Hochman commented that the grand jury indictment is a step closer to trial and achieving justice, calling the alleged act "a profound betrayal by someone who was loved and trusted by the very people he is accused of killing."
Nick Reiner, 32, pleaded not guilty to two counts of murder in February. He also faces a special allegation for personally using a knife in the commission of the crime. It remains unclear if an insanity defense will be pursued, particularly given his history of drug addiction and mental health issues.
Rob and Michele Reiner were found stabbed to death in their Brentwood, California, home on December 14, 2025. Rob Reiner was 78 and Michele Reiner was 70. Nick Reiner fled the scene but was apprehended later that evening. He is scheduled for a pretrial hearing on September 15.
