Lindsay Clancy's defense attorney has filed a motion to dismiss the murder case against her, asserting that the state did not adequately prove her control over her actions during the incident. The filing comes after a mistrial was declared last Friday when a jury could not reach a unanimous verdict in the case.
In the motion submitted to Plymouth County Superior Court on Thursday, attorney Kevin Reddington argued that the Plymouth County District Attorney's Office should not be permitted to retry Clancy. The jury, composed of nine women and three men, was unable to reach a unanimous decision, with one juror reportedly holding out against a finding of not guilty by reason of insanity.
Clancy was charged with three counts of first-degree murder in the deaths of her children, Cora, 5, Dawson, 3, and Callan, 8 months old. The children were found deceased in their Duxbury, Massachusetts, home on January 24, 2023. Prosecutors alleged that Clancy strangled the children with exercise bands in the basement of their home before attempting to take her own life. She reportedly cut her wrists and neck and then jumped from a second-floor window.
The defense has centered on the argument that Clancy was not in control of her actions at the time of the deaths, a claim that was central to the jury's inability to reach a verdict. The recent mistrial means the case's future now hinges on the outcome of the dismissal motion.
