A scheduled court hearing for Kroy “KJ” Biermann Jr., the 15-year-old son of reality television personality Kim Zolciak, was canceled Tuesday following his indictment on seven felony charges in connection with a sexual assault case. The indictment, filed on September 3, has become the controlling action in the case, leading to the cancellation of the preliminary hearing.

KJ’s attorney, Jason Sheffield, confirmed the cancellation, stating that a new judge will be assigned and several future court dates are expected. These include a motion to transfer the case to juvenile court, a bond hearing, and an arraignment on the current indictment, scheduled for October 14. Sheffield indicated that the defense intends to enter not guilty pleas to all charges.

Sheffield expressed his intention to file a motion for the case to be transferred to juvenile court, aiming for his client to be tried as a juvenile. The state, however, has indicated its intent to try KJ as an adult, which was the matter slated for the canceled hearing.

Since his arrest on August 17, KJ has been held at Atlanta’s Metro Regional Youth Detention Center. The Georgia grand jury indicted him on charges including aggravated child molestation, aggravated sodomy, aggravated sexual battery, three counts of sexual battery against a child under 16, and false imprisonment. These charges stem from an alleged encounter on April 23 with a female classmate at a Life Time fitness center in Alpharetta, Georgia.

Court documents previously obtained state that the accuser alleged KJ forced sexual acts upon her in the gym’s family changing room despite her objections. Sheffield has asserted his client's innocence, stating that evidence, including a polygraph test, has been presented, and claims of other prior false allegations by the accuser exist. He also noted that investigators reportedly found no male DNA in the areas where the alleged assault occurred, describing KJ's arrest and detention without bond as a tragedy.

Zolciak has publicly defended her son, calling the allegations "reckless and deeply troubling" and expressing confidence in the eventual establishment of the truth through facts and evidence. She has reportedly visited her son multiple times while he has been in custody.

KJ Biermann Jr. is one of four children Zolciak had with Kroy Biermann, alongside Jagger Jr., Kash Kade, and twins Kaia Rose and Kane Ren. Zolciak also has two adult daughters, Brielle and Ariana, from previous relationships, whom Kroy Biermann adopted in 2013.
