PROVO, Utah — A preliminary hearing for Tyler Robinson, accused in the assassination of Turning Point USA founder Charlie Kirk, concluded Friday without a ruling, but the week-long proceeding introduced substantial evidence that has begun to dismantle conspiracy theories surrounding the case. Judge Tony Graf Jr. agreed to a defense request for briefs, adding approximately six weeks to the process before a decision is made on whether Robinson's case will proceed to trial. A next hearing is scheduled for September 1.
Robinson, 23, is accused of shooting Kirk, 31, from a rooftop sniper's perch during a Turning Point USA event at Utah Valley University on Sept. 10, 2025. Amid intense public interest and closed-door proceedings, several conspiracy theories have emerged, many of which were directly addressed by evidence presented in court.
Cause and Manner of Death
Testimony from Utah State Bureau of Investigation Agent David Hull stated Kirk's death was a homicide caused by a gunshot wound to the neck. The forensic pathologist who performed the autopsy found nothing inconsistent with this conclusion, ruling out theories involving an exploding microphone. While some speculation centered on the lack of a visible exit wound in video footage of the murder, the autopsy doctor maintained confidence that a gunshot was the cause of death. James Gagliano, a retired FBI supervisory special agent and Fox News contributor, noted that the caliber of the bullet fragments recovered from Kirk's body was consistent with the suspected murder weapon, even if tool mark analysis from the fragments themselves was inconclusive. The defense highlighted the recovery of unrelated weapons and an empty pistol holster near the scene, as well as an unfired .223 round found on a nearby roof.
Suspect's Height and Campus Presence
One theory posited that Robinson was too short to be the suspect seen in surveillance video. Robinson is listed at 5 feet, 10 inches tall. Prosecutors presented surveillance footage showing a Dodge Challenger, identified as Robinson's vehicle, arriving and departing the campus. They also introduced evidence of Robinson's DNA allegedly found on a screwdriver near the sniper's perch and on the suspected murder weapon. Independent journalist Tayler Hansen recreated the alleged suspect's route across campus, filming himself for comparison. Hansen, who is six feet tall, concluded that the height difference was negligible, suggesting the theory was unfounded.
Investigators asserted they could place Robinson on campus multiple times the day of the murder using video, physical, and digital evidence, including cell phone data. Surveillance footage reportedly shows him arriving in the morning, leaving, and returning later in different clothing. Evidence also indicates Robinson allegedly made contact with Turning Point USA representatives on campus.
Clothing and Witness Testimony
Social media claims that multiple individuals wore maroon shirts on the day of the killing were also addressed. Prosecutors presented compilation videos showing the suspect in different outfits, including one with a maroon T-shirt, and another with a black long-sleeved shirt. They allege Robinson appears in both. Surveillance footage reportedly shows the suspect exiting a gray Dodge Challenger in the school's parking garage, a vehicle matching Robinson's. Video evidence also shows Robinson wearing a maroon T-shirt when he surrendered to authorities.
The testimony of Lance Twiggs, Robinson's former roommate, was a significant part of the hearing. A redacted video of Twiggs' interview with prosecutors was played in court. The defense attempted to prevent the public from hearing Twiggs' testimony and seeing text messages, Discord chat logs, and a handwritten note from Robinson to Twiggs, which prosecutors allege contain admissions of guilt. Judge Graf allowed this evidence to be presented, and the defense offered no evidence to support theories of foreign government involvement in Kirk's murder.
