Heather Mashburn-Smith, 37, was sentenced Thursday to seven years in prison and 15 years of probation after pleading guilty to unlawful activity with a minor. The incident occurred in April at Port Charlotte High School, where authorities alleged Mashburn-Smith had sexual relations with a 17-year-old student on campus on two occasions that month.
The Charlotte County Sheriff’s Office stated that Mashburn-Smith exploited the vulnerability of the student she was entrusted to protect. The age of consent in Florida is 18.
Following her arrest on April 29, Mashburn-Smith provided a full confession to authorities. The charge was elevated to a first-degree felony due to her status as a teacher. She was credited with 118 days for time served.
Sheriff Bill Prummell commented on the case, stating that Mashburn-Smith's actions were not only unlawful but also damaging to students and staff. Mashburn-Smith had been suspended from her teaching position following the allegations.
Representatives from the Charlotte County Sheriff’s Office, Clerk’s Office, and the Charlotte County School District did not immediately respond to requests for comment regarding the final judgment.
