California has enacted what has been described as the largest tax increase in the state's history, with Governor Gavin Newsom signing a budget that includes new taxes on health insurance premiums and software downloads. The legislative action aims to offset a loss in federal revenue, according to state Democrats.

Republicans have criticized the budget, with state Senator Roger Niello arguing that record spending does not improve quality of life and is detrimental to job creators and workers.

Health Care Tax

A significant component of the new tax plan involves extending a tax on health care providers, which is projected to generate approximately $2 billion annually. This revenue is intended to support Medi-Cal, the state's Medicaid program. Individuals with private health insurance may experience an average annual increase of about $100 in their premiums, while families of four could see an increase of around $400, as insurers are expected to pass on these costs.

State Republicans have voiced concerns about this health care tax, even calling for intervention from the Trump administration, asserting that the tax requires approval from the Centers for Medicare and Medicaid Services.

Software Download Tax

The second major tax initiative will classify "prewritten" software products as personal property, subjecting them to California's high sales tax rate. This tax is estimated to bring in $900 million annually, according to legislative analysis. California's base sales tax is 7.25%, with additional local taxes bringing the total rate significantly higher in some areas.

The new tax will apply to digital products used by both businesses and individuals, including communication platforms like Slack, creation tools such as Adobe, and tax preparation software like TurboTax. While the Legislative Analyst's Office noted that the software tax would primarily affect business-to-business transactions, it also cautioned that businesses often pass these costs on to consumers, potentially leading to further price increases and inefficiencies.

Governor Newsom's office has defended the budget, attributing the necessity of the health care tax to actions taken by the Trump administration. A statement from the Governor's press office suggested that the health tax was a consequence of federal policy changes, stating, "TRUMP hiked your costs, not Governor Newsom!"
