Andrew and Tristan Tate are being held in jail in the United States and plan to fight extradition to the United Kingdom, their lawyer stated Monday after the siblings appeared in court. The influencers were arrested Saturday in Miami on charges including rape and sex trafficking, with pending charges in the UK alleging abuse of women between July 2010 and August 2017.

A US district judge will determine in the coming weeks whether the Tates meet the conditions for extradition, with a further hearing scheduled for July 27. Their lawyer, Joseph McBride, asserted their innocence, stating they have done nothing wrong and should not be extradited for crimes they did not commit. McBride also suggested the extradition attempt was politically motivated and linked to the current political climate in the UK.

McBride further claimed that the brothers' arrest was not a coincidence, occurring after they met with elected officials in Washington D.C. The Daily Mail reported that the arrests followed meetings with Representative Wesley Hunt and attendance at a private event hosted by former President Donald Trump's special envoy Paolo Zampolli.

According to the Crown Prosecution Service, the charges against the Tates include seven counts of rape, three counts of arranging or facilitating trafficking for sexual exploitation, and three counts of assault occasioning actual bodily harm for Andrew. He also faces 19 additional charges related to indecent images of children and extreme pornography. Tristan is charged with one count of sexual assault, two counts of rape, and three counts of arranging or facilitating trafficking for sexual exploitation.

The brothers are facing a combined 59 new charges

Both brothers have pleaded not guilty to all charges worldwide. Their lawyer anticipates legal proceedings to last approximately 60 days.

The brothers, who are dual US and British citizens and have resided in Romania since 2016, were first arrested in Romania in December 2022. They were formally charged in June 2023 with human trafficking and forming an organized crime group to sexually exploit women, with Andrew also charged with rape. Romanian prosecutors expanded their investigation in August 2024 to include money laundering, witness intimidation, and complicity in the trafficking of minors.

British prosecutors filed their own charges in May 2025, including rape, actual bodily harm, and human trafficking. Romanian courts had previously ruled that the Tates would be extradited to the UK after proceedings in Romania concluded, though a Bucharest court of appeals sent the case back to prosecutors in 2024, removing certain evidence deemed inadmissible.

In February 2025, the Tates traveled from Romania to Florida after a travel ban was lifted, a move reportedly influenced by figures within the Trump administration. ProPublica reported at the time that a White House official intervened to have federal agents return electronic devices seized from the brothers upon their arrival in Florida. McBride reiterated his earlier claims that President Trump would support the Tate brothers.

Andrew Tate, who has amassed over 10 million followers on X (formerly Twitter), has been banned from platforms like YouTube, TikTok, and Instagram for violating hate speech guidelines. His controversial rhetoric includes comments that women who are sexually assaulted bear some responsibility and criticisms of mental health treatment.
