A High Court judge has ruled in favor of luxury florist Flowerbx Ltd in a trademark dispute against a competitor with a nearly identical name. Flowerbx, which counts Victoria Beckham, Julianne Moore, Louis Vuitton, Dior, and Jimmy Choo among its clients, argued that Lukasz Gajewski's company, Flowers Box London Ltd, had breached its trademark and unfairly benefited from Flowerbx's reputation.
Whitney Bromberg Hawkings, a former executive at Gucci and Tom Ford, founded Flowerbx in 2015, specializing in high-end floral displays. The company registered its trademark in July 2017, emphasizing its reputation for "luxury and stylish floral design of the highest quality." By 2025, Flowerbx was projected to achieve over £4 million in annual turnover.
Mr. Gajewski established his business, Flowers Box London Ltd, in 2019. The court heard that customers mistakenly left five-star reviews for Mr. Gajewski's company that were intended for Flowerbx, and that some customers purchased flowers from the rival business believing it to be Flowerbx's brand. Ms. Bromberg Hawkings became aware of the confusion in late 2023 when a bus driver told her he had bought flowers from her, only for her to discover he had actually purchased them from Mr. Gajewski's firm.
Recorder Amanda Michaels ruled that Mr. Gajewski's business had breached the trademark by using "Flowers Box" or "Flowers Box London." The judge stated that the rival business gained an "unfair advantage" by profiting from Flowerbx's established reputation and hard work. While the name may have been adopted innocently, the court found that Mr. Gajewski's company traded with knowledge of Flowerbx's business, citing evidence of Mr. Gajewski's visits to Flowerbx's website and subscription to its marketing emails.
Flowerbx's success in court means Mr. Gajewski's company may be liable for damages. The exact amount will be determined in a separate court hearing.
Flowerbx has been recognized for its collaborations with high-profile brands and events, including work with fashion designer Emilia Wickstead and providing floral arrangements for Victoria and David Beckham's 50th birthday celebrations.
