Russell Brand, convicted of one count of rape and three counts of sexual assault, could face a prison sentence of at least ten years for the rape conviction alone, according to Eleanor Laws KC, a leading sex crimes barrister. Laws, who co-authored a guide for lawyers on charging and sentencing sex crimes, discussed the potential sentencing implications in an exclusive episode of The Trial podcast.
Brand, 51, was found guilty by jurors at Southwark Crown Court and remanded into custody ahead of his sentencing on Monday. The jury determined that he had anally raped a 21-year-old fan at his Hampstead home in 2009 and sexually assaulted three other women between 2004 and 2005, including an MTV worker and a Capital Radio worker. He was acquitted of two other rape charges and one count of attempted indecent assault.
Laws explained that sentencing guidelines for rape offenses can range from five to 15 years, with a starting point as high as ten years if aggravating factors such as additional humiliation or significant planning are considered by the judge. She noted that the judge must also consider the three additional sexual assault convictions.
"If you have a starting point of ten years, say, you have then got to consider that there are three other sexual assaults, three other victims," Laws stated. "The judge will look at what the starting points are for those and again, if there was humiliation in any of them, there may be at the very least a starting point of something like 18 months for one."
During the four-week trial, the jury heard testimony from the six women involved in the allegations. Evidence presented in court described the 2009 rape, where the victim stated Brand ordered her to shower before he raped her. Another assault detailed in court involved a Channel 4 worker who was allegedly pressured into giving Brand a massage while his associates watched and laughed.
Laws also highlighted the complexity of sentencing when multiple victims are involved. The judge must decide whether to impose consecutive sentences for each offense, potentially adjusting the total to account for the totality of the crimes, or to have some sentences run concurrently alongside the sentence for the lead offense.
Brand is scheduled to be sentenced at Southwark Crown Court on Monday. Award-winning court reporters Caroline Cheetham and Liz Hull are expected to report on the proceedings for The Trial podcast.
