David Morgan, 40, is on trial accused of the murder of father-of-three Richard Smith, 50, who died after being struck by Morgan's vehicle on May 8 in Norwich.
Jurors have been shown CCTV footage depicting Morgan drinking at the Sole and Heel pub in Rackheath, near Norwich, on the day of the incident. The court heard that Morgan consumed four pints of lager before leaving the pub around 3 p.m. to pick up his children from primary school. Footage from the pub's car park shows Morgan performing a U-turn and speeding away.
Later, Morgan returned to the pub with his children. It was during a subsequent journey into Norwich around 5 p.m. that the collision with Mr. Smith occurred. Mr. Smith, who was cycling home from work, was thrown from his bike after allegedly being hit by Morgan's white Mercedes. He sustained severe head injuries and died in hospital three days later.
Witnesses told police that Morgan appeared to deliberately swerve his vehicle into Mr. Smith. One woman driving in front of Morgan reported hearing the cyclist shout at the Mercedes driver, calling him a "dhead" or "khead." She then observed the Mercedes move left and strike the cyclist. Another witness driving in the opposite direction reported seeing the Mercedes driver gesturing at the cyclist.
In a phone call recorded by a neighbor's security camera after the collision, Morgan can be heard saying, "I said 'F*** you, you c***' and swerved into him. He's moved, hit the kerb and gone flying… I swerved into him and went 'F*** you'… and he's knocked off." He also stated, "No c*** is going to touch my car."
During his arrest later that evening, Morgan slurred and admitted to having had a drink. He was breathalysed at the police station and found to have 57mg of alcohol per 100ml of breath, exceeding the legal limit of 35mg.
Morgan has pleaded guilty to a second charge of manslaughter. The trial continues.
