As Democrats celebrate a historic victory in Texas, a Republican lawmaker is making an eleventh-hour push to limit the powers of the incoming governor. State Rep. Brian Harrison has publicly called on outgoing Republican Gov. Greg Abbott to convene a special session before Democratic Gov.-elect Gina Hinojosa is sworn in.

Harrison stated that the remaining ten weeks of Republican control should be used to "restore separation of powers and limit the emergency powers that Governor-Elect Hinojosa is set to inherit." He expressed concern that these powers could allow Hinojosa to "destroy liberty in Texas by executive fiat." Harrison also argued that Texas governors should not possess "unchecked" emergency powers, regardless of party affiliation.

Under Texas law, the governor can declare a state of disaster and exercise emergency powers, including suspending regulatory requirements. These declarations must be renewed every 30 days and can be terminated by the Legislature. Harrison specifically referenced HB911, legislation he filed in December 2022, which aimed to restrict the governor’s emergency powers.

Hinojosa, who made history by becoming the state's first Latina governor, pledged during her campaign to declare a high-cost emergency upon taking office. Her stated intentions include issuing executive orders to halt state gas and diesel taxes and freeze residential electricity rates. She is scheduled to officially assume office in January 2027.

Democrats achieved several statewide victories in Texas, including James Talarico's defeat of Republican Attorney General Ken Paxton. Despite the party's successes, some Republican state senators have vowed to "hold the line" against Democratic policy initiatives.

Outgoing Gov. Abbott has stated he will assist Hinojosa and her team during the transition period. Texas Sen. Ted Cruz lamented the Democratic victories, noting that it has been decades since Texas last had a Democratic governor or senator. Former President Donald Trump criticized Abbott's loss, attributing it to his being a "RINO" (Republican in name only).
