Stephen A. Smith Questions ESPN's Different Rules for Pat McAfee

Stephen A. Smith has suggested that Pat McAfee enjoys a distinct set of operating rules at ESPN, differentiating his independent contractor status from Smith's own position as a direct employee. Smith, who signed a five-year, $100 million contract with ESPN in 2023, noted that McAfee's arrangement with the network differs significantly.
McAfee joined ESPN in 2023 with a reported $30 million-a-year deal for 'The Pat McAfee Show,' a contract that requires him to cover his own production and staffing costs. He is also slated for an expanded role on ESPN's 'Monday Night Countdown' and is reportedly in negotiations for a new deal valued at over $60 million annually, according to The Athletic.
"Pat McAfee has a level of independence I've never had," Smith stated in an interview with Front Office Sports. "He owns his own platforms. He leases that to ESPN. I'm employed by ESPN because ESPN owns First Take. I don't own First Take, they do."
Smith elaborated that while McAfee is part of ESPN's programming, his operational framework is distinct. "He just leases his show to ESPN; We work for ESPN. And so that's not to imply that Pat is not a part of the team because he's on ESPN's airwaves. But there's a different set of rules that we're obligated and culpable and attached to that he's not."
Smith acknowledged that he possesses certain freedoms within the industry due to his contractual agreements. "I do have freedoms that the average person doesn't have in this business, and I get that part," he said. "And there's a lot of things that I can do because I negotiated the contractual right to do them; the reality is that's an entirely different world than Pat McAfee."
He concluded by emphasizing McAfee's self-determination: "Pat McAfee, when he says he's his own boss, he truly is his own boss."
The network has drawn attention for its significant contracts with personalities like Smith and McAfee amidst recent rounds of layoffs. McAfee himself addressed this narrative, stating that while he and his team are proud of their work, it's "terrible" that people lost their jobs. He acknowledged the difficult decisions companies make and expressed gratitude for his partnership with ESPN and Disney.
