British Father Pleads for Leniency After Son's Fatal Fall in Cyprus

A British father who pleaded guilty to negligence in the death of his 3-year-old son has appealed to a Cypriot judge to spare him a prison sentence, arguing that the profound loss he and his family have endured constitutes sufficient punishment. The incident occurred on July 12 when the boy fell approximately 40 feet from a hotel window in Paphos, Cyprus.

During court proceedings on Tuesday, the father's lawyer, Alexandros Alexandrou, told the Paphos District Court that his client's guilty plea acknowledged a momentary lapse in judgment, not willful negligence. "That fraction of a second will haunt him for the rest of his life," Alexandrou stated to Judge Froso Christodoulidou, emphasizing that the defendant and his family will carry this burden indefinitely.

Evidence presented in court indicated that the 38-year-old defendant, his son, and his father-in-law were returning to their fourth-floor hotel room at the King Evelthon hotel after a day at the pool. The father reportedly lifted the child to look out a window towards the hotel's waterpark when the boy slipped and fell. Alexandrou noted that the defendant does not recall the exact circumstances of the fall due to its rapid occurrence, but he and his father-in-law informed investigators they believed the window pane was closed.

The defendant, visibly distressed and tearful, was present in court. His parents also attended, his mother weeping.

Prosecutor Chryso Perganti informed the court that the child suffered fatal injuries, including multiple skull and bone fractures and damage to vital organs, and was pronounced dead at a hospital. A blood sample taken from the defendant about six hours after the fall indicated he had consumed alcohol, falling below the legal limit at that time. However, experts estimated his blood alcohol level at the time of the incident could have been more than twice the legal limit.

Alexandrou countered that the defendant's alcohol consumption was not a factor, as there was no evidence of impairment. The lawyer also highlighted the potential professional repercussions for his client, an auditor at a U.K. firm, who faces losing his job and professional license due to the proceedings, even if a sentence is suspended.

The charge of negligence carries a maximum prison sentence of four years. Imprisonment can be suspended if the sentence is three years or less. Judge Christodoulidou is scheduled to deliver her ruling on October 16.

Cyprus, a popular tourist destination for British holidaymakers, receives millions of visitors annually.
