Australian Court Orders Life Sentence Without Parole for Mushroom Poisonings

An Australian appeals court on Friday ordered Erin Patterson, convicted of poisoning four relatives of her estranged husband with death cap mushrooms, to never be released from prison. The decision cited the "shocking criminality" involved in the case.

The three judges of the Victoria state Court of Appeal dismissed Patterson's appeal of her convictions and overturned the 33-year non-parole sentence she had previously received. This means Patterson will spend the remainder of her life in prison, as she will not be eligible for parole.

"In all the circumstances after anxious consideration, we have concluded that the case involved such shocking criminality that it is inappropriate to fix a nonparole period," Justice Stephen McLeish stated on behalf of the court. He described the offending as "extraordinarily cold and calculated."

Patterson's convictions stem from a family meal she hosted in July 2023, where beef Wellington dishes were served containing death cap mushrooms. Her parents-in-law, Don and Gail Patterson, and Gail's sister, Heather Wilkinson, died within days of the meal. Heather's husband, Ian Wilkinson, survived after a lengthy hospital stay and testified against Patterson.

Patterson maintained that she accidentally included the poisonous mushrooms in the meal. Prosecutors argued during the appeal hearing that the initial sentence did not adequately reflect the "calculated criminality" of the case. The court noted that Patterson's intent to murder all four individuals was sustained over nearly three weeks, involving "elaborate series of deceptions," such as falsely claiming a cancer diagnosis to explain the absence of her children from the lunch.

The judges also highlighted that Patterson destroyed evidence, denied foraging for mushrooms, and made repeated false claims about their origin, describing the actions as "carefully planned and deliberate" and a "cruel breach of trust." Patterson is the second woman in Australia to be sentenced to life imprisonment without the possibility of parole. She can still apply to Australia's High Court to overturn the verdicts on her sentence and convictions.

The case has garnered significant international media attention and has been the subject of podcasts, books, and upcoming screen adaptations. Actress Melanie Lynskey is set to star as Erin Patterson in a six-episode series for Paramount+. Patterson is being held in a high-security unit within Melbourne’s Dame Phyllis Frost Centre women’s prison due to her notoriety and perceived risk from other inmates. She watched the verdict via video link from prison and did not attend court.
