WWE performer Ludwig Kaiser alleges that a profane remark referencing ICE instigated the physical altercation that led to his battery arrest earlier this year. In a motion to dismiss his misdemeanor case, Kaiser, whose real name is Marcel Barthel, claims the dispute began on April 23 when Richard Reap became offended by the couple's public display of affection in an apartment complex elevator.
According to Kaiser's court filing, Reap told the couple to "have some f—ing respect" before directing a vulgar comment at Kaiser's girlfriend, who is of Mexican descent. Kaiser stated that Reap yelled, "Have some respect before I call ICE on that bitch."
Kaiser asserted that he exited the elevator to inform Reap his statements were offensive and inappropriate. He further alleged that Reap raised his hands aggressively and approached him, prompting Kaiser to act in self-defense out of fear of an imminent physical attack. Kaiser stated he pushed Reap away.
Following this, Kaiser re-entered the elevator, but Reap allegedly approached again in a "threatening manner." Kaiser claims he pushed Reap away a second time. The filing states that Reap then threw a soft drink bottle at Kaiser, who responded by continuing to his floor and leaving the area.
Kaiser's motion contends that the battery charge against him should be dismissed, arguing that his use of non-deadly force was justified as he reasonably believed it was necessary to prevent unlawful force against himself or his girlfriend.
In contrast, an arrest warrant affidavit filed by Orange County, Fla. authorities states that Reap told officers Kaiser punched him multiple times and pushed him to the ground. Cops noted redness and a large, fresh scratch on the back of Reap's head, consistent with a recent physical altercation. Reap had reportedly asked the couple to "please have some manners" before the incident. A judge was scheduled to rule on the motion on Thursday, but the hearing was continued to August 27.
