Woman Who Helped Husband Die Walks Free After Pleading Guilty to Assisting Suicide

Kylie Ellina Truswell-Mobbs, 52, walked out of a Brisbane Supreme Court to cheers and embraces from supporters on Monday after pleading guilty to assisting her terminally ill husband's suicide. She had faced a potential life sentence on a murder charge.

Prosecutors accepted Truswell-Mobbs's guilty plea to the lesser offense of assisting suicide in the death of her 56-year-old husband, David Ronald Mobbs, at their Alexandra Hills home in December 2023. Mr. Mobbs was suffering from an aggressive form of motor neurone disease (MND).

Justice Tom Sullivan sentenced Truswell-Mobbs to two years' imprisonment, suspended immediately, acknowledging her compassionate motives. She had already spent 14 months in custody.

"It feels good," Truswell-Mobbs told reporters outside the court. "(David) was beautiful. He will never be forgotten about."

Mr. Mobbs was diagnosed with MND in April 2023, and his condition rapidly progressed, leaving him paralyzed, bedridden, and unable to move without assistance within months. He had a terminal diagnosis and was reportedly told that accessing voluntary assisted dying, legislation for which had been activated in early 2023, would take nine days or more.

By December 5, 2023, Mr. Mobbs could no longer speak and communicated only by blinking, making noises, or using a letter board with assistance. He was also in pain and distressed by his loss of bodily control. His defense barrister, Ruth O'Gorman, stated that he begged to die that night and that his wishes were known to his sons and several carers.

Mr. Mobbs died on December 6, 2023. Justice Sullivan noted the challenging nature of the sentencing due to a lack of similar cases and the time Truswell-Mobbs had already served.
