Tyler Robinson, 22, who was arrested Thursday night on suspicion of killing conservative commentator Charlie Kirk at a Utah Valley University event, could be housed for the remainder of his life at the Utah State Correctional Facility if convicted and sentenced to death, officials and reports say.
Robinson faces charges including aggravated murder, first-degree obstruction of justice and felony discharge of a firearm causing serious bodily injury. Utah Governor Spencer Cox said the state intends to seek the death penalty. The Utah State Correctional Facility in Salt Lake City replaced the old state prison in 2022 and contains the state’s death row and execution chamber; Utah statutes provide for lethal injection and the firing squad as execution methods.
The $1 billion facility, built with multiple security levels and capacity for 3,600 beds, was designed to offer expanded medical, mental health and geriatric services and to house both male and female inmates across security classifications. State officials have reported a current population of roughly 2,500 inmates.
Since opening, the prison has experienced an array of operational problems that have drawn scrutiny from corrections officials and state lawmakers. This spring, the Utah Department of Health reported that 140 inmates in a housing unit were treated for scabies after a geriatric patient tested positive, prompting testing and cleaning of bedding and living areas. Scabies is caused by parasitic mites and is highly contagious by close skin contact.
The facility’s location adjacent to wetlands has contributed to mosquito infestations. In response to complaints from staff and inmates, the Utah Legislature approved about $300,000 to address the problem and the Utah Department of Corrections distributed lotion-based mosquito repellent in July 2023. Officials said repellent access varies by security level, with higher-security inmates permitted use only during recreational periods.
Prison officials and news reports have also documented attempts to smuggle drugs into the facility. At least three visitors were arrested over an eight-day span for allegedly bringing contraband to inmates, including an incident in which a visitor cut a hole in a plexiglass barrier to pass what officers believe was strips of Suboxone, a medication used to treat opioid addiction.
Staffing shortages and safety incidents have compounded operational challenges. In January 2023, three correctional officers were assaulted inside the new facility, spurring the installation of additional cameras and other safety measures. In early 2023 the facility acknowledged it was operating with fewer than half the roughly 135 correctional officers officials said were required for full staffing. Low staffing has, at times, forced closures of housing units and required rotating officers from other state prisons to cover shifts.
Despite the problems, the facility has continued programming for inmates. In August, facility officials held a half-marathon in which 45 inmates participated after months of training, illustrating an effort to maintain recreational and rehabilitative activities.
The correctional complex has also been preparing for executions in the new building. Authorities moved execution equipment, including a gurney used for lethal injections, and set up an execution chamber with a black, strapped chair surrounded by black-padded walls ahead of a planned execution this year. That execution — the first scheduled in the new facility — was halted by the Utah Supreme Court days before it was to proceed pending a competency evaluation of the inmate, according to court filings and news reports.
If Robinson is convicted and sentenced to death, he would join a small number of inmates on Utah’s death row. Executions in the state are rare and the methods permitted under state law include both lethal injection and the firing squad; a firing squad execution would be conducted by a team of shooters.
Robinson’s arrest followed the fatal shooting of Kirk at an event at Utah Valley University in Orem. Local and state authorities continue to investigate the circumstances of the shooting and the allegations against Robinson as prosecutors prepare criminal filings. Any potential transfer to the Utah State Correctional Facility would occur after conviction and sentencing, subject to court proceedings and prison placement decisions.
