Tyler Robinson Hearing Ends Without Trial Date Set in Charlie Kirk Murder Case
Lawyers for the accused assassin and the victim's widow clashed over scheduling during a Utah court hearing.
A pretrial hearing for Tyler Robinson, 23, accused of assassinating Charlie Kirk at a Turning Point USA event, concluded Friday without a trial date being set, prompting frustration from the victim's widow's legal team.
Judge Tony Graf Jr. stated he needed more time to consider scheduling after hearing arguments from both the prosecution and defense regarding expected timelines and commitments in other cases. Robinson, who appeared in a light gray suit, remained silent and conferred quietly with his attorneys during breaks.
Utah County prosecutors had proposed January 31, 2028, as a potential trial date, but indicated they could be ready by October 2027. The defense, however, requested a trial date in the third quarter of 2029, citing the extensive discovery materials and other trial preparations, as well as prior commitments, including a federal racketeering case scheduled for January 10, 2028, that conflicts with the prosecution's suggested timeline.
Jeffrey Neiman, an attorney for Kirk's widow, Erika Kirk, expressed his client's dismay, stating, "Justice delayed this long stops being justice for the Kirk family." He emphasized that under Utah's constitution, victims have a right to a speedy resolution and urged the judge to set a date.
Conversely, defense attorney Richard Novak argued against rushing the proceedings, asserting that "setting a trial date does not lead to closure, it does not lead to finality, it leads to mistakes." Both legal teams agreed that scheduling a trial through the holiday season could pose difficulties for potential jurors and witnesses.
Graf acknowledged concerns about potential future scheduling conflicts if a date is not established soon. He has scheduled the next hearing for Monday, November 9, at 1 p.m. MT, at which time he is expected to issue a ruling on the matter. Robinson is charged with aggravated murder and six other counts in connection with the Sept. 10, 2025, fatal shooting of Charlie Kirk at Utah Valley University.
