The Trump administration has filed lawsuits against California and Virginia, challenging new state laws that restrict the sale of semi-automatic firearms. The Justice Department contends these laws violate the Second Amendment of the U.S. Constitution.
Acting Attorney General Todd Blanche stated that the Second Amendment is not a "suggestion" or a "second-class right." The legal challenges come as both states have implemented measures targeting specific types of firearms.
Virginia’s governor signed legislation earlier this year banning the sale and manufacture of certain semi-automatic firearms, which took effect on Wednesday. This law is reportedly facing at least four other legal challenges. Virginia's Attorney General's office defended the ban as a "commonsense" measure aimed at enhancing public safety and protecting law enforcement. The governor's office echoed this sentiment, stating that firearms designed for "maximum casualties" have no place in communities, particularly near children and schools.
In California, a law prohibits gun shops from selling certain handguns that can be easily converted to fully automatic. The Justice Department's lawsuit specifically targets restrictions on the sale of Glock and Glock-style pistols, described as among the most popular handguns in the U.S., as well as additional handgun sale restrictions.
The California attorney general’s office asserted that the state possesses "effective and constitutional gun safety laws" that have contributed to record low firearm death rates. The lawsuit highlights a growing divergence in gun legislation between states led by Democrats and those led by Republicans, with some Republican-led states enacting laws to ease firearm restrictions.
This legal action by the Justice Department occurs as the U.S. Supreme Court is set to review another significant Second Amendment case concerning whether bans on semi-automatic rifles violate the Constitution. Arguments in that case are expected in the fall. The Supreme Court, which has a conservative majority, has expanded gun rights in recent years.
