Trump Administration Ad on Fox News Sparks Controversy Over Taxpayer Funding
Critics allege the campaign-style ad violates federal rules against using government funds for political purposes, while the White House maintains it is an "educational" public service announcement.
A campaign-style advertisement featuring President Trump, which aired on Fox News and carried the disclosure "Paid for by the U.S. Government," has drawn criticism from Democrats who argue it violates federal regulations prohibiting the use of taxpayer dollars for political campaigns. The 30-second spot was reportedly seen on Fox News on a Wednesday evening and ran multiple times overnight, according to media monitoring service TVEyes.
Rep. Jamie Raskin, the top Democrat on the House Judiciary Committee, condemned the ad, stating on X that it could constitute "felony criminal theft and conversion of government property for political campaign purposes." He also asserted that it may be a Hatch Act violation for any government employees involved in its creation or who used government resources. The Hatch Act limits political activities for federal employees and some state and local government workers involved in federally funded programs.
The White House defended the ad, describing it as a "public service announcement" that is "educational" and not political. A White House spokesperson stated, "These public service announcements are about reminding Americans to love their country and understand what makes it worth defending, at home, at our borders, and abroad. The ad is educational and unapologetically patriotic. We should be proud of our country." An official added that the PSAs are "clearly not political" because "The President is not on the ballot and the ads don't have a call to action."
The advertisement appears similar to a 30-second video titled "America Will Never Be a Communist Country," uploaded to the White House YouTube page on September 13. In the video, Trump states, "Together we will defeat communism, socialism and Marxism in America. America will never be a communist country." The ad shown on Fox News includes phrases like "LARGEST TAX CUTS IN HISTORY," "REIGNITING AMERICAN MANUFACTURING," and "DEFEND LAW AND ORDER AND POLICE" displayed in text over rapid succession of images of President Trump. It also includes a clip from UFC CEO Dana White's speech at the Republican National Convention, in which he called Trump "the toughest, most resilient person I've ever met."
According to the Congressional Research Service, no single agency is responsible for overseeing department advertising budgets. Restrictions on the use of public funds for PSAs include a ban on using funds for "publicity or propaganda purposes not authorized by the Congress" in agency appropriations bills. Kevin Kosar, a senior fellow at the American Enterprise Institute and author of a 2014 CRS report, commented that the advertisement "looks like puffery."
