Travelers Entitled to Full Refund After East Coast Flight Disruptions

Thousands of flights to and from East Coast airports were disrupted on Monday due to a severed fiber optic cable, leading to significant travel chaos. Under U.S. law, passengers affected by these cancellations are entitled to a full cash refund, according to legal expert Eric Napoli, chief legal officer at AirHelp.

While the incident was outside of airline control, U.S. domestic law mandates a full refund if a flight is canceled or significantly disrupted. Napoli explained that if travelers choose not to accept alternative flight arrangements offered by the airline, they are eligible for their money back. However, accepting a rebooked flight typically means forfeiting the refund option, as it implies the passenger has consumed part of the service.

U.S. Transportation Secretary Sean Duffy initially blamed Amtrak, stating a construction crew cut the cable. Amtrak, however, responded that the incident occurred on New Jersey Transit property and involved a New Jersey Transit contractor. NJ Transit acknowledged work at the site but asserted their crew was digging away from utility markings.

Napoli clarified that while European regulations offer compensation up to $700 for delays directly attributable to airlines, this situation does not qualify for such compensation. The disruptions were caused by a "tower-to-ground issue" entirely outside the airlines' operational control.

For other potential accommodations, such as food vouchers, transportation, or lodging, Napoli advised travelers to be proactive in their requests. He noted that airlines are often willing to assist, but passengers should not expect these provisions unless they ask for them. Napoli recommended that travelers utilize resources like AirHelp's website and app for information and assistance navigating such disruptions.

He also cautioned travelers to remain calm and civil when dealing with airport staff, emphasizing that anger will not improve the situation. Being informed and prepared, he advised, is the best approach when unforeseen travel issues arise.
