Top UK Planning Barrister Faces Neighbor Dispute Over Rooftop Pergola

Charlie Banner KC, Britain's leading planning barrister, is embroiled in a contentious dispute with his neighbors over a timber pergola erected on the roof of his £3 million London townhouse. The structure, draped with artificial greenery and festoon lights, was installed on the terrace of the couple's Kensington home without initial planning permission.

The pergola, intended to provide shade during warmer months, has drawn strong objections from some neighbors who claim it looms over their properties, blocks light, and should have been submitted for council approval. A retrospective planning application has since been filed by Banner's wife, barrister Tetyana Nesterchuk.

Banner and Nesterchuk, through representatives, deny any deliberate attempt to bypass planning regulations. They maintain that the structure, in their view and that of their agents, does not require planning consent as it is a temporary-style addition. A source close to the family has described the objections as "vexatious" and "classic NIMBYism."

The dispute escalated after the pergola appeared in July, prompting a complaint to the Royal Borough of Kensington and Chelsea officials. A planning officer has since deemed the structure "unpermitted" and warned of potential enforcement action if permission was found to be necessary. The couple's representatives state that the retrospective application was submitted "out of an abundance of caution and to preserve goodwill."

One neighbor, a new mother, described the pergola as "intrusive" and "incredibly stressful," stating it "dominates every view across all our floors" and obstructs morning light. She also noted that lights from the structure glare into her home when she is trying to watch television and expressed concern that Banner's prominence might influence the decision.

Banner, who was voted the top planning KC in Britain for 2025 and 2026 by Planning Magazine, has extensive experience with complex planning cases, including HS2 and Heathrow expansion. Nesterchuk is also a successful commercial lawyer. The couple has been sanctioned by the Kremlin for their advocacy for Ukraine.

Other objectors have described the pergola as "large, dense and visually dominant" and warned that allowing it could set a "dreadful precedent." Concerns were also raised about fire safety due to the artificial foliage, though it is understood to be fire-retardant.

Conversely, at least 12 letters of support for the structure have been submitted to the council. Supporters argue that high-quality pergolas are beneficial for providing shade during hot summers and enhance the usability of roof terraces. One resident noted that the greenery is "very attractive and of high quality" and meets the need for shade in light of climate predictions.

The townhouse is located within a conservation area, where alterations to buildings are subject to strict controls.

The Royal Borough of Kensington and Chelsea Council confirmed that a retrospective permission application has been received and is currently undergoing consultation with neighboring residents before a decision is made. The council stated that no enforcement action has been taken, and that the application has garnered significant support from neighbors and the local residents' association, with supporters reportedly outnumbering objectors considerably.

This situation is not the first time Lord Banner has been in the news.
