Milwaukee County Sheriff's Office deputies found an open alcohol container on the passenger side of Tony Romo's vehicle during his July 23 arrest on suspicion of operating while intoxicated (OWI), according to citations released by the sheriff's office. The former Dallas Cowboys quarterback was stopped for a traffic violation after attending a golf event. Romo, who is currently the lead NFL commentator for CBS Sports, refused a breathalyzer test and subsequently failed a field sobriety test.
When questioned by officers at the scene, Romo stated that he had consumed "zero" alcoholic beverages that day. He also informed officers that he was rushing to visit his grandparents, though public obituaries reviewed by The Sporting News indicate they are deceased. The Daily Mail has reported that Romo's attorney has been contacted for comment regarding the alleged open container.
Romo is facing an OWI charge that carries a potential $1,066 fine, in addition to a $235 penalty for the moving violation. His court date is scheduled for September 21.
Footage obtained by The Daily Mail appears to show Romo, 46, exhibiting signs of impairment during the sobriety tests. He is heard complaining about pain from previous back surgeries and asking officers to allow him to exit the police cruiser to alleviate discomfort. Before commencing the sobriety exercises, Romo was observed stretching his back against the hood of the police car.
During the interaction, Romo repeatedly interrupted the officer explaining the sobriety tests, asking for repetitions or demonstrations. When asked if he would submit to a breath test, Romo refused, stating, "Oh no, we're not doing that. I've heard from all the lawyers 'don't ever do that.'"
According to reports, Romo initially expressed surprise at being pulled over. The officer stated the reason for the stop was "unsafe passing on the right" and "cutting across the gore." Romo indicated he was coming from a golf course and heading to meet his grandparents, who were reportedly waiting to catch a flight. After the officer returned with his driver's license, she asked about his alcohol consumption, to which Romo responded, "Zero."
Upon learning of the officer's intention to conduct a field sobriety test, Romo attempted to retrieve his cell phone, stating he would call his lawyer and film the encounter. After eventually exiting his Jeep, Romo questioned the officer, "Because I'm coming from a golf course you think I'm drunk?" The officer then informed him he was being detained for OWI and placed him in handcuffs before transporting him to a secure location for testing.
