Tesla Driver Cited for Allegedly Napping While Using Full Self-Driving
California Highway Patrol stopped a driver who appeared to be asleep at the wheel of a Tesla traveling at 60 mph.
A Tesla driver in Solano County, California, was stopped by the California Highway Patrol (CHP) for allegedly sleeping behind the wheel while the vehicle was traveling at 60 mph with the Full Self-Driving (FSD) feature engaged.
A CHP motorcycle officer observed the driver slumped over and wearing dark sunglasses, prompting the officer to pull the vehicle over. Authorities stated that the driver received a citation for unsafe speed and was educated on the proper use of driver-assistance technology.
"Power naps belong in a parking spot, not in the driver’s seat," the CHP commented on the incident via social media. The agency emphasized that Tesla's FSD system is a Level 2 driver assistance tool, requiring drivers to remain attentive and ready to take control at all times. They clarified that such technology assists driving but does not replace the driver and does not provide legal authorization for drivers to sleep while the car is in motion.
This incident is one of several in which drivers have been observed allegedly misusing driver-assistance technology. In May, a Cybertruck driver was reportedly seen dozing while driving on Highway 101 in Marin County. At that time, the CHP reiterated that drivers remain responsible for their vehicles, regardless of any advanced features, and that sleeping behind the wheel violates California's basic speed law.
In a separate case in March, Vacaville police arrested a driver suspected of driving under the influence after officers found the motorist passed out behind the wheel of a Tesla that was reportedly using its driver-assistance system. The vehicle was observed moving through city streets, and officers found the driver asleep with a pizza box and miniature wine bottles nearby.
