The teenage son of reality television personalities Kim Zolciak and Kroy Biermann is facing a potential 25-year prison sentence if convicted of felony charges related to an alleged sexual assault. KJ, who was 14 at the time of the alleged incident and is now 15, denies all charges.

His attorney, Jason Sheffield, filed a motion with the Fulton County Court requesting the case be moved to Georgia's juvenile justice system. Sheffield argued that KJ is too young to be tried as an adult and could still be rehabilitated if his case is handled in juvenile court, rather than facing a mandatory minimum sentence of 25 years to life without parole in the adult system.

"At fifteen, KJ’s story is not finished," Sheffield stated in court documents. "That proposition is not sentimental. It is developmental reality, and it is embedded in Georgia’s statutory scheme." He emphasized that the juvenile system is designed to accommodate the developmental differences between children and adults, focusing on accountability, supervision, and rehabilitation.

The alleged assault occurred on April 23 at a Life Time fitness center in Alpharetta, Georgia. According to Fulton County Juvenile Court papers, the alleged victim stated that she and KJ went into a family changing room, where she claims he touched her, forced her to perform oral sex, and attempted to have sexual intercourse with her. She stated she was able to get away from him. An officer was dispatched to North Fulton Hospital on April 24 for a reported sexual assault, and the alleged victim was examined.

According to court documents obtained by the Daily Mail, the alleged victim's father also claimed the incident occurred at the gym. The examination report noted no evidence of male DNA found in the alleged victim's mouth or vagina. Zolciak has publicly stated that her son passed a polygraph examination related to the allegations and that no DNA belonging to him was found, calling the accusations "reckless and deeply troubling."

Sheffield has also requested that parts of the upcoming transfer hearing be closed and that juvenile records be sealed to protect the privacy of KJ, the alleged victim, and any other minors involved. He argued that public dissemination of identities and conduct could cause harm and potentially "contaminate recollections" of witnesses.

KJ remains in custody and is scheduled for court appearances, including a bond hearing and arraignment on the current indictment. His attorney indicated that they expect to enter not guilty pleas to all charges and will continue to advocate for the case to be transferred to juvenile court.

Zolciak and Biermann, who divorced in 2023 after 12 years of marriage, have six children together. Their ongoing custody dispute has also been a factor in recent legal proceedings, with a judge granting Biermann primary physical custody of their four minor children in June.
