Attorneys for social media influencers Andrew and Tristan Tate have asked a Miami federal court to release the brothers, arguing that their prominent public profiles and history of compliance with legal proceedings constitute special circumstances warranting their freedom as they fight extradition to the United Kingdom. The brothers are accused in the UK of rape and sex trafficking.

A judge is set to determine next week whether the Tates should remain detained or be released while the extradition process unfolds, which could last months. Prosecutors are expected to file a response to the defense's motion by Monday.

The defense motion acknowledges a presumption against bond in extradition cases but asserts that release can be granted under special circumstances. The lawyers contend that the Tates' high public visibility makes fleeing highly improbable, citing their regular social media updates about their locations. They also point to the brothers' adherence to pretrial restrictions in Romania, where they previously faced accusations of luring women for sexual exploitation, as evidence they are not a flight risk.

"Every prediction the government now asks this Court to make about the brothers’ future conduct — that they will flee if released — has already been made and answered by three years of data showing that they do not flee," the motion states.

The UK has a mid-September deadline to provide evidence to the U.S. State Department to support the extradition request. The motion details the restrictive conditions the Tates face at the Federal Detention Center in Miami, including limited contact with family, and no access to television, radio, or commissary, stating these conditions violate due process for individuals not convicted of a crime.

The new allegations in the UK involve four additional accusers and relate to events spanning from 2010 to 2017. British prosecutors stated these charges include rape, assault, trafficking, and offenses concerning "indecent images of a child and extreme pornography." These are in addition to existing UK charges involving rape, bodily harm, human trafficking, and controlling prostitution for gain, allegedly against three other accusers between 2012 and 2015.

The brothers, who moved to Romania in 2016, were arrested there in 2022 on charges related to schemes to lure women for sexual exploitation. The Romanian case has faced legal and procedural challenges, and the Tates' attorneys argue that the UK's extradition request seeks to bypass the Romanian court's order deferring their surrender.
