Tyler Robinson, the suspect accused of murdering conservative commentator Charlie Kirk, appeared in a Utah court Monday for a preliminary hearing, during which he was reportedly seen laughing. Kirk's widow, Erika Kirk, who was present with her in-laws, wept throughout the proceedings.
Robinson, 23, faces a charge of aggravated murder in connection with Kirk's death on September 10. Prosecutors allege that Kirk was shot while addressing a crowd of thousands during a Turning Point USA event at Utah Valley University. Robinson surrendered to authorities after the shooting and is alleged to have sent a text message confession to his transgender partner.
During the hearing, which is expected to last five days, a Utah Valley University police officer, Chris Bagley, testified about the moments leading up to and immediately after the shooting. Bagley stated he had a clear line of sight to Kirk and heard a gunshot while Kirk was answering a question. He observed people fleeing the scene before police confirmed a suspect was in custody.
Erika Kirk, accompanied by Charlie Kirk's parents Robert and Kathryn Kirk, left the courtroom shortly after Bagley began his testimony. Kathryn Kirk was seen with a packet of tissues, and Erika leaned on a friend for comfort. Robinson reportedly observed court exhibits and took notes.
Robinson has not entered a plea. His defense attorneys have sought to have the death penalty removed as a possible sentence. The judge previously denied a defense request to remove the death penalty option, and prosecutors plan to argue that Kirk's shooting endangered others, a factor that can lead to a death sentence in Utah.
This preliminary hearing will determine if there are sufficient grounds to proceed to trial. Prosecutors need only demonstrate reasonable grounds to believe Robinson killed Kirk, a lower standard than the "beyond a reasonable doubt" required for a conviction at trial. Prosecutors are expected to present between 40 and 50 exhibits, including videos of the event, DNA evidence, autopsy findings, and witness statements.
Robinson's roommate, who is also his partner, is not expected to testify in person, but recorded testimony may be presented. Prosecutors have stated that Robinson's alleged text message indicated he targeted Kirk because he "had enough of his hatred."
Charlie Kirk was a prominent conservative figure who co-founded Turning Point USA, an organization aimed at mobilizing young conservatives. Donald Trump Jr. and his wife, Kimberly Guilfoyle, were present in court to support Erika Kirk.
The family of Charlie Kirk released a statement ahead of the hearing, noting that his death "irrevocably impacted our lives" and that "every court proceeding serves as a painful reminder of his death." Erika Kirk stated during her husband's memorial service that she forgives Robinson.
