Supreme Court to Hear Challenge to ICE's Mandatory Detention Policy

The Supreme Court has agreed to consider a significant legal challenge to the Immigration and Customs Enforcement's (ICE) mandatory detention policy. The court's decision will address whether criminal noncitizens held in detention while their deportation cases proceed are guaranteed bond hearings, particularly after extended periods of incarceration. This policy has faced repeated challenges and blockades in lower courts.

The case's path to the Supreme Court involved an attempt by New York Governor Kathy Hochul in August to render the case moot. She issued pardons to criminal aliens who had been held in detention centers for extended periods. However, the Trump administration had asked the justices to review the case prior to this action.

Solicitor General John Sauer, who had previously acknowledged the case might be moot following the pardons, stated in September that efforts would continue to find a new case to address the core legal question. This question centers on whether the Due Process Clause of the Fifth Amendment entitles criminal noncitizens to bond hearings.
