Kroy Biermann Jr., the 15-year-old son of "Real Housewives of Atlanta" alum Kim Zolciak and former NFL player Kroy Biermann, has been arrested on charges of aggravated sodomy and aggravated sexual battery. His mug shot was released following his apprehension by the Alpharetta Police Department in Georgia.
According to court documents, a female classmate accused Biermann Jr. of assaulting her on April 23 in a gym changing area. The accuser claims the assault occurred in a co-ed sauna, where she alleged Biermann Jr. attempted to force himself on her despite her objections and allegedly tried to engage in sexual intercourse, pull down her pants, and perform digital penetration. The filing states the accuser managed to escape and subsequently left the premises.
The alleged victim reportedly did not immediately report the incident but contacted her family the following day, expressing distress. She sought medical examination at North Fulton Hospital on April 24. A police report indicated that the examination found no evidence of male DNA in the areas specified by the accuser.
Biermann Jr. was taken into custody on Monday and is being held without bond at the Juvenile Court of Fulton County. A court appearance is scheduled for September 1.
Attorneys for Biermann Jr. have asserted his innocence. In a statement, his legal representative, Jason Sheffield, claimed that evidence, including a polygraph test administered by a respected polygrapher, supports Biermann Jr.'s claim of innocence. Sheffield also mentioned the existence of evidence suggesting prior false allegations made by the accuser and pointed to the police report noting a lack of DNA evidence as grounds for questioning the charges. "He is not only presumed innocent, but is, in fact, innocent," Sheffield stated, urging the public not to prejudge the case and to respect the privacy of both families involved.
Zolciak also issued a statement through a representative, calling the allegations "reckless and deeply troubling." She stated that her son "categorically denies ever being involved with this woman or engaging in the conduct she has alleged." The statement indicated that Biermann Jr. voluntarily took a polygraph examination related to the allegations and passed, and that a subsequent examination found no DNA belonging to him. Zolciak's representative also raised concerns about similar allegations reportedly made by the accuser against two other individuals, suggesting these claims warrant careful scrutiny. The statement emphasized that false accusations can have severe consequences and stressed the importance of allowing the legal process to unfold based on facts and evidence rather than unproven allegations.
Kim Zolciak and Kroy Biermann are currently going through a contentious divorce, which began in 2023. They share three other children: Kash, 14, and twins Kaia and Kane, 12. Zolciak also has two daughters from previous relationships, Brielle, 29, and Ariana, 24.
