Emily Moreno, daughter of Senator Bernie Moreno and ex-wife of Congressman Max Miller, has filed for a restraining order against the Ohio Republican, alleging he harassed her attorney and physically touched him without consent. The filing marks a new development in the contentious divorce and custody battle between Moreno and Miller.

Moreno claims in the court filing that Miller's counsel stated the Congressman "just can't control himself." She also alleges that Miller has harassed, threatened, and communicated directly with her legal teams, including her current attorney, Andrew Zashin. According to the filing, Miller physically touched Zashin without consent.

Moreno and Miller, who share a young daughter, have had restraining orders against each other. Moreno has accused Miller of years of alleged physical abuse, including claims he harmed their child. The couple finalized a divorce settlement in June 2025, agreeing to joint custody and $2,500 per month in child support from Miller.

Miller has denied all allegations and filed a countersuit alleging domestic abuse against Moreno. However, a judge recently dismissed Miller's case, finding he had not been harmed or feared for his safety. Miller had filed to drop his case in May, but the request was not processed until this week.

Recent alleged incidents cited in court documents include an event on February 1, where Miller allegedly grabbed and struck Moreno during a custody exchange at his Ohio home. Moreno claims this left bruises on her arm, elbow, and torso, with their two-year-old daughter present. An earlier incident on June 9, 2024, involved allegations that Miller hurled a pot of boiling water at Moreno during an argument, with some splashing their then-eight-month-old daughter, according to Moreno's claims.

Miller has denied wrongdoing and previously stated that the allegations would not impact his re-election bid. He has received support from some GOP colleagues, with House Judiciary Chairman Jim Jordan telling CNN, "This is a family matter. I know Max is a good man."

Moreno filed to alter the custody arrangement on March 4, citing her ex-husband's "dangerous physical behavior" in their daughter's presence. A source familiar with the marriage told the Daily Mail that Miller is "spiraling out of control and everyone in Washington knows it."
