Retired Teacher Wins Legal Battle Over Garden Gate Access
An 81-year-old former teacher has successfully concluded a three-year legal fight against a council to regain access through her garden gate.
Helene Ball, an 81-year-old retired teacher, has won a legal battle against Derbyshire County Council after a metal fence was erected over a gap in her garden wall, preventing her access to an adjoining car park.
Mrs. Ball, who has resided in her Matlock home since 1967, stated that she and her family had used the route through the 98cm gap in her rear garden wall for over 40 years without issue. The fence was cemented in place in April 2023, initiating a legal dispute that has since incurred costs of approximately £50,000.
A judge has ruled in favor of Mrs. Ball, acknowledging her prescriptive rights to the access route. The ruling mandates that this access will be added to the land's deed. The council has also been ordered to cover Mrs. Ball's legal costs and ensure that her pedestrian and vehicular access is no longer impeded.
The fence panel over her rear garden gate was removed within a year of its installation, but the vehicular access remained blocked for the entire three-year period. During this time, the council-owned car park had been listed for sale as a potential small housing development.
According to the Derby Telegraph, Judge Robert Brown criticized the council's legal representation as "surprisingly combative" and "pugnacious," noting its "limited evidence" and "unsubstantiated assertions." The judge found parts of the council's arguments to be "totally irrelevant" and "most unhelpful."
Mrs. Ball described the council's actions as "babyish" and "beyond childish," expressing her disappointment with their attempts to intimidate her. She stated, "I just want to live peacefully. I am a strong woman and it has brought out my stubborn side. I dealt with bullies at school and then found myself being bullied again."
Her son, David, supported her throughout the legal battle, stating that the council had "tried to shut us down for three years and shut down every form of resolution or negotiation." He described the fence's installation, which occurred two weeks after the second anniversary of his father's death, as a "completely unnecessary act of aggression."
Council workers are currently in the process of installing concrete blocks at the car park's entrance to create a vehicular route to Mrs. Ball's rear garden. The legal challenge began under a previous Conservative-controlled council administration, with the final hearing taking place under the current Reform UK control.
