Retired Teacher Wins £50,000 Legal Battle Against Council Over Garden Gate Access
An 81-year-old former teacher has successfully defended her right to use a garden pathway after a three-year legal dispute with a local council.
Helene Ball, an 81-year-old retired teacher, has won a three-year legal battle against Derbyshire County Council, securing the right to access her property via a pathway through a neighboring council-owned car park. The dispute began in April 2023 when a metal fence was erected, blocking a 98cm gap in her rear garden wall that she and her family had used for over 40 years.
The legal fight has reportedly cost around £50,000, but a judge has now ruled in Mrs. Ball's favor, establishing prescriptive rights for her continued access, which will be added to her property deed. The council has also been ordered to cover Mrs. Ball's legal costs and ensure her access is not impeded again.
The fence panel blocking pedestrian access was removed within a year, but vehicular access remained blocked until recently. The car park had also been listed for sale as a potential housing development.
During the proceedings, the court noted the council's legal representation was "surprisingly combative" and "pugnacious," with "limited evidence" and "unsubstantiated assertions." The judge described some of the council's arguments as "totally irrelevant" and "most unhelpful."
Mrs. Ball expressed her dismay at the council's actions, likening their behavior to that of a spoiled child and accusing them of attempting to bully her. She stated, "I just want to live peacefully. I am a strong woman and it has brought out my stubborn side." She added that the prolonged stress of the legal battle had been significant, particularly at her age.
Her son, David, who supported her throughout the legal battle, highlighted the council's "malice and incompetence" and their "wilful intent" to deny their claim. He noted that the fence was installed two weeks after the second anniversary of his father's death, which added to the family's distress.
Council workers are now in the process of installing concrete blocks to create a vehicular route from the car park entrance to Mrs. Ball's rear garden. The legal challenge began under a previous Conservative administration, with the final tribunal hearing occurring under Reform UK leadership.
