Ralph Carr Appeals Rape Conviction and Sentence

Disgraced Australian sports and entertainment manager Ralph Carr has filed an appeal against his conviction and sentence for rape and sexual assault. The legal move was made on Tuesday, following a statement from a close friend of the former agent indicating an appeal was certain.

Carr, prosecuted under his full name Ralph Carnovale-Carr, was found by a jury to have raped a woman multiple times at his Melbourne West warehouse home in March 2023. He appeared at the Melbourne County Court via videolink from the Melbourne Assessment Prison on August 25, where he was sentenced to a maximum of six years imprisonment. He was convicted on two counts of rape and one charge of sexual assault.

A bid for a stay of sentence was made by Carr's legal team in an attempt to gain his release, but the application was refused. Carr will remain at the Melbourne Assessment Prison while awaiting a lengthy wait for his appeal to be heard, meaning he is expected to spend Christmas incarcerated.

Dermot Dann KC, representing Carr, argued in court that the guilty verdicts represented "the most obvious miscarriage of justice" he had witnessed in over three decades of legal practice. He stated that his client maintained his innocence. Dann also informed the court that Carr's unmasking had impacted his mental health, leading to suicidal thoughts, depressive symptoms, and anxiety.

The court heard that Carr, who was formerly married to pop star Tina Arena, had engaged in self-harm by banging his head against a wall shortly after his conviction.

The conviction stemmed from an incident on March 24, 2023, where Carr raped the woman twice at his Melbourne home. The incident occurred after the woman became upset discussing a relationship breakup. The court heard Carr initiated physical contact, which the woman attempted to resist. Despite her attempts to stop him, Carr proceeded to rape her twice, as she cried into a pillow.

The victim did not submit a victim impact statement to the court.

Judge Frank Gucciardo refused the stay of sentence application, describing Carr's actions as "very serious" and "appalling." The judge emphasized that the rape was committed in an "egregious breach of trust" and was predatory and opportunistic behavior towards a vulnerable woman who had placed her trust in him.

Carr was known for managing the careers of artists such as Vanessa Amorosi and Kate Ceberano, as well as public figures like Richard Wilkins and AFL player Dustin Martin.

Judge Gucciardo acknowledged that Carr's career was over, deeming it "extracurricular punishment." Carr was sentenced to a maximum of six years imprisonment, with a minimum term of four years.
