Prosecutors Seek Gag Order in Lindsay Clancy Case Following Mistrial

Prosecutors in the Lindsay Clancy case have filed a motion for a gag order, seeking to prevent attorneys and others involved from making public statements that could prejudice the proceedings. The motion comes ahead of a pivotal hearing to determine the future of the case, which ended in a mistrial on September 4.

Lindsay Clancy, 36, admitted to strangling her children—Cora, 5, Dawson, 3, and eight-month-old Callan—in January 2023. Her defense has argued she was not guilty by reason of insanity, citing postpartum psychosis. Despite 11 of 12 jurors finding sufficient evidence for an insanity defense, a single holdout juror led to the mistrial.

The prosecution's motion specifically criticized Clancy's defense attorney, Kevin Reddington, for speaking to the media after the mistrial was declared. The filing stated, "Most disturbing, defense counsel spoke to the media about the deliberating jurors in this case."

Clancy has hired new legal counsel, veteran Boston defense attorney Martin Weinberg, who represented Karen Read in a previous mistrial. Weinberg is expected to argue for the case to be dismissed on double jeopardy grounds, citing the Fifth Amendment protection against being tried twice for the same crime. It remains unclear if this argument will apply, as no verdict was reached in the initial trial.

The defense is also seeking information regarding the holdout juror, including cell phone records and surveillance footage from the courthouse. Meanwhile, prosecutors are expected to reveal their plans for a potential retrial, including whether they will pursue the same or lesser charges.

Supporters of Lindsay Clancy gathered outside the Plymouth County Superior Court ahead of the Tuesday hearing. A woman was reportedly escorted out of the courtroom before the proceedings began after speaking to the prosecution team.
