Prosecutors Seek Gag Order in Lindsay Clancy Case After Mistrial

Prosecutors in the murder trial of Lindsay Clancy have filed a motion seeking a gag order, requesting that the judge prohibit attorneys and others involved in the case from making public statements that could prejudice the proceedings. The motion was filed following a mistrial declared on September 4.

Clancy, a former labor and delivery nurse, admitted to killing her three children—Cora, 5, Dawson, 3, and Callan, 8 months—at their Duxbury, Massachusetts, home in January 2023, using exercise bands. Her defense argued that she was experiencing postpartum depression and psychosis due to prescribed medications.

The five-week trial concluded with a mistrial after one juror, identified as Michael Desronvil, refused to acquid Clancy, preventing a unanimous verdict. Following the mistrial, several jurors spoke to the media, accusing Desronvil of failing to follow the law regarding reasonable doubt.

In their filing on Tuesday, Plymouth County District Attorney Timothy Cruz's office specifically criticized Clancy's defense attorney, Kevin Reddington, for speaking to the media about the deliberating jurors after the mistrial was declared. The prosecution's motion argues that such statements have a "substantial likelihood of materially prejudicing the criminal proceedings."

Clancy is scheduled to return to Plymouth County Superior Court for a hearing that could determine the next steps in her case, including whether she will face a second trial. Defense attorneys are expected to file motions, potentially seeking to dismiss charges based on lack of criminal responsibility or double jeopardy rules. The defense is also seeking information about the holdout juror.

Michael Desronvil, the lone holdout juror, previously stated in a video to Fox News' Sean Hannity that "we want to reel everything back and put the focus on the three angels."
