Prosecutors have asked a Georgia court to allow forensic interviews with minor children in connection with the felony sex assault case involving Kroy Biermann Jr., also known as KJ. The 15-year-old, son of reality television personalities Kim Zolciak and Kroy Biermann, was arrested last month and indicted on seven felony charges, including aggravated sexual battery, aggravated child molestation, aggravated sodomy, and false imprisonment.
KJ was recently granted a $200,000 bond with strict conditions following his arrest on August 17. The charges stem from an alleged incident on April 23. Fulton County prosecutors filed an emergency motion on Thursday requesting court orders for accredited professionals to conduct the interviews, aiming to gather pertinent details for the case.
At a previous bond hearing, Deputy District Attorney Caitlin McGillicuddy informed the court that a video had been recovered from KJ's phone depicting him in sexual relations with a relative under 12. The prosecutor claimed the video showed KJ using "predatory, derogatory" language and indicated this was the second time he had faced charges of a serious sexual nature involving female victims.
Records indicate KJ remains under court supervision from a prior juvenile court incident involving charges of sexual battery of a victim under 16. KJ's attorney, Jason Sheffield, has stated that the characterizations of the prior juvenile matter "grossly misrepresent both the facts and the ultimate resolution of that case," describing it as "inappropriate, crude behavior involving two middle-schoolers" that did not result in an adjudication for statutory rape or a comparable offense.
Kim Zolciak has maintained her son's innocence, calling the allegations "reckless and deeply troubling." She stated that KJ voluntarily took and passed a polygraph examination related to the current allegations and that an examination of the alleged victim found no DNA belonging to her son. Zolciak has expressed confidence that the facts and evidence will establish the truth and asked for the legal process to unfold without the spread of unproven allegations.
According to Fulton County Juvenile Court documents, the alleged victim stated the incident occurred in a family changing room at a gym. She claimed KJ began touching her after she said no, then allegedly forced her to perform oral sex and attempted sexual intercourse before she managed to escape. A police report from April 24 states an officer was dispatched to North Fulton Hospital for a reported sexual assault occurring at a nearby gym. The report noted that an examination of the alleged victim found no evidence of male DNA in her mouth or vagina.
Kroy Biermann Jr. faces a potential sentence of up to 25 years in prison if convicted on the current charges. An arraignment is slated for October 14.
