Parents Alexus and Angelo Fiordilino will not face negligence charges in connection with their 18-month-old son Vincent Lorenzo Fiordilino being found alive in a hospital morgue, Maricopa County Attorney Rachel Mitchell announced.

Vincent was discovered face down in the family's backyard pool in Gilbert, Arizona, on February 8. His parents pulled him from the water and performed CPR before he was transported to Mercy Gilbert Medical Center. Dr. Aryan Toosi pronounced the toddler dead approximately one hour after arrival. However, medical professionals found Vincent alive in the hospital morgue later that evening.

The Gilbert Police Department had recommended charges against the parents, but Mitchell determined that a conviction beyond a reasonable doubt was unlikely. "The family had multiple childproof locks and safety measures in place, and multiple adults were present in the home, all of whom believed someone was watching the child," Mitchell stated. The investigation found no evidence of parental impairment.

Records from the incident reveal that police officers repeatedly informed Dr. Toosi that the child was still breathing. An officer reported hearing a nurse state "I have a pulse" before other hospital staff attempted to revive Vincent. The officer then approached Dr. Toosi, who was speaking with the parents, and relayed this information. According to the report, Dr. Toosi responded assertively, stating, "Toosi arrogantly told me he was the doctor, he has a medical degree, he went to medical school for a reason, and to let him do his thing."

Vincent was airlifted to Phoenix Children's Hospital, where an MRI confirmed he suffered extensive brain damage requiring lifelong care. The family plans to pursue legal action against Dignity Health Mercy Gilbert Medical Center.

Dr. Toosi has held an osteopathic physician license since 2023 and completed his emergency medicine residency in 2022. The Daily Mail reported that the parents had allegedly been smoking marijuana in the garage of their home prior to discovering their son in the pool.
