Olivier Martinez Objects to Halle Berry's Daughter Testifying in Custody Dispute
Martinez wants son Maceo to testify while arguing Berry's daughter Nahla is biased and irrelevant to the case.
Olivier Martinez has asked a judge to prevent Halle Berry's daughter, Nahla Aubry, from testifying in their ongoing custody dispute over their son, Maceo. Martinez stated in court documents that Aubry "does not have any significant bearing on this case" and is "unquestionably biased."
"I do not believe it is appropriate for [Berry] to try to insert her daughter into litigation that does not involve her," the documents read. In contrast, Martinez, 60, has requested that their 13-year-old son, Maceo, be allowed to "address the court" to share his experiences regarding allegations of abuse made against Berry.
"Given that our son is 13 years old, I believe it would certainly be in his best interest for him to address the court at this time," Martinez argued in the filings. "He should have the opportunity to have his voice heard regarding what he experienced that night. … I believe that our son’s testimony will be the key to the Court learning the full truth about the events that occurred on September 26th. I am the parent who wants the truth to come out. I am the parent who does not want to suppress Maceo’s voice."
Last week, Nahla, whom Berry, 60, shares with ex-partner Gabriel Aubry, provided a statement in court documents defending her mother. The 18-year-old described Berry as a "loving and devoted parent" who "can be strict when necessary." Nahla asserted that she has "never seen my mom place her hands around Maceo’s neck, put him in a chokehold, restrict his breathing, or engage in any conduct remotely resembling the allegations that have been made against her."
Martinez previously filed a temporary restraining order against Berry last month, accusing her of physically abusing Maceo. Berry's legal team vehemently denied these claims. In the court documents obtained by Page Six, Martinez alleged that Berry jumped on Maceo, placed her hands around his neck, and choked him. Martinez claimed that Maceo, described as "traumatized" and panicked, called him to pick him up after the alleged incident, stating he did not want to return to his mother's house.
Following Martinez's filing, he was granted primary custody of Maceo, and Berry lost 50/50 custody, with her visitation limited to two days a week and every other weekend. She was also ordered to stay more than 100 yards away from Martinez. Berry and Martinez were married from 2013 to 2016.
