Oklahoma Secretary of State Benjamin Lepak was arrested Friday night on suspicion of public intoxication outside a McDonald's in Edmond, according to an arrest affidavit. The incident has prompted Oklahoma Attorney General Gentner Drummond to call for his immediate firing by Gov. Kevin Stitt.
Police responded to a report of a man appearing to be intoxicated in public around 10:45 p.m. Officers found Lepak near the restaurant's drive-thru window, with his vehicle in the parking lot. According to the affidavit, officers noted Lepak's speech was "extremely slurred" and detected an "odor of an alcoholic beverage coming from his breath." He also reportedly struggled to produce his identification.
Body camera footage obtained by Fox News Digital shows officers questioning Lepak about his whereabouts, alcohol consumption, and how he arrived at the McDonald's. Lepak told officers he had attended a church gathering earlier that evening. He acknowledged drinking beer but stated he had consumed less than one beer. Police alleged Lepak was unable to maintain a coherent train of thought and provided contradictory statements regarding whether he drove to the location.
A spokesperson for Lepak stated that he was waiting for dinner and that no breathalyzer test was administered. The spokesperson added that Lepak would address the ticket through the legal process.
Following the arrest, Attorney General Drummond issued a news release demanding Gov. Stitt terminate Lepak. Drummond cited the bodycam footage, stating it was clear Lepak was "thoroughly inebriated" and likely misled law enforcement. He called the conduct "thoroughly unbecoming of a such a high ranking state official."
Drummond also criticized Stitt's decision to appoint Lepak, referencing a prior arrest involving Lepak and accusing the governor of making poor judgment calls in appointments. Stitt appointed Lepak as Oklahoma Secretary of State in October 2025. Lepak previously served as the governor's general counsel and as executive director of the State Chamber Research Foundation.
