An attorney for the Oklahoma State Bureau of Investigation (OSBI) is under review following a viral video in which she advocated against complying with Immigration and Customs Enforcement (ICE) and encouraged citizens to make agents' lives difficult. The remarks have drawn condemnation from the Department of Homeland Security and the Oklahoma Attorney General's office.
In the video, posted on TikTok and reshared on X, the attorney, identified as Shannon (Hoyle) Desherow, stated that she would refuse to comply with ICE agents, asserting they lack jurisdiction over U.S. citizens. She further claimed that ICE administrative warrants are insufficient for Fourth Amendment protections and do not grant agents authority to enter homes, vehicles, or make arrests.
"And an ICE warrant, by the way, 99% of the time, is an administrative warrant. It’s not good enough for the f---ing Fourth Amendment," Desherow said in the video. "It doesn’t give you access to my house, it doesn’t give you access to my car, and it certainly doesn’t give you access to f---ing arrest me. I was born here, and I’m going to make it an ICE agent’s problem. I don’t have to f---ing comply with ICE, because I was born here. And every citizen needs to have that f---ing mindset. We need to make their lives f---ing miserable, and that’s exactly what we should be doing."
The Department of Homeland Security responded by emphasizing that obstructing law enforcement is a federal crime. A spokesperson stated, "The First Amendment protects speech and peaceful assembly – not rioting." The spokesperson also noted that ICE officers are experiencing a significant increase in assaults as they apprehend individuals accused of serious crimes.
A spokesperson for the OSBI confirmed that the agency is aware of the video and is investigating the matter. According to her LinkedIn profile, Desherow serves as an assistant general counsel for the OSBI. Her TikTok account has since been made private.
Oklahoma Attorney General Gentner Drummond issued a statement on X, clarifying that Desherow's comments do not represent the views of Oklahoma or its law enforcement professionals. "Anyone in Oklahoma law enforcement who feels so passionately against our federal partners should resign," Drummond stated. "Homeland Security, FBI, DEA and ICE are critical allies to Oklahoma and my office as we combat organized crime. An attack against one of them is an attack on the entire system that protects our life, liberty and pursuit of happiness."
