New Evidence Challenges Prosecution's Narrative in Gaudreau Brothers' Fatal Crash Case

New photographic and cartographic evidence has emerged in the case involving the fatal crash that killed NHL star Johnny Gaudreau and his brother, Matthew. The defense team released these materials on Monday, suggesting that the alleged drunk driver, Sean Higgins, may not have been reckless at the time of the collision.

The newly surfaced images depict the severely damaged bicycles ridden by the brothers and the crushed front end of Higgins' black SUV. Accompanying maps illustrate the alleged positions of the vehicle and the cyclists at the moment of impact. According to the defense, these schematics indicate that the collision occurred in a different location on the road than what was initially reported by the police.

Police reports stated that the brothers were on the shoulder of the road when they were struck, but Higgins' legal team contends they were in the roadway. An expert for the defense stated in new court documents that "There is no physical evidence that defines precisely where the point of impact was (either laterally or longitudinally) along the roadway." The expert further argued that the evidence indicates "the cyclists were within the northbound travel lane (and not on the extremely narrow shoulder) immediately prior to impact."

Higgins' attorney is also asserting that the Gaudreau brothers were riding without necessary lights and on a poorly lit section of the road. The defense expert questioned the prosecution's analysis, stating, "Even when simply accepting the police analysis at face value, it is unclear how this analysis establishes that Mr. Higgins was responsible for the occurrence of the subject collision event."

Photographs within the court filings display a Trek road bike with its rear wheel missing and front wheel severely bent, as well as a Cervelo triathlon bike with a missing saddle and a bent rear wheel. The images also show significant damage to Higgins' Jeep Grand Cherokee, including a cracked windshield and a crumpled front end.

The evidence was submitted as part of a filing on October 5, when Higgins' legal team argued that Salem County prosecutors should disclose the evidence used to reconstruct the crash. The defense aims to challenge this reconstruction with their own expert analysis.

Higgins, a 45-year-old Army veteran, is scheduled to go to trial on January 5. He faces charges for allegedly driving with a blood alcohol content of .087 and striking the brothers while they were cycling in Oldmans Township on August 29, 2024. The legal blood alcohol limit for driving in New Jersey is .08.

According to reports, the Gaudreau brothers were returning from their sister's wedding rehearsal dinner when Higgins allegedly passed another vehicle and collided with them. The defense's new evidence and arguments could potentially complicate the prosecution's case.
