A Menlo College student is being held without bail on charges of sexually assaulting a 12-year-old girl, while investigators are examining the possibility of additional victims. Andres Manuel Aguilar, 19, faces two counts of forcible sexual assault, including rape and oral copulation, and one count of felony providing marijuana to a juvenile.
The alleged encounter occurred on May 5, according to prosecutors. The preliminary hearing in the case was continued to August 27 to allow investigators more time to complete their probe and for prosecutors to determine if further charges are warranted based on evidence concerning a potential second victim.
Prosecutors allege that the girl left her home after meeting Aguilar at a Menlo Park bus stop. Despite the girl stating she was 17, prosecutors say Aguilar was aware she was underage. The two reportedly went to a Safeway store, then returned to Aguilar's dorm room at Menlo College. There, they allegedly consumed alcohol and vaped marijuana before Aguilar committed the sexual assault, despite the girl's repeated objections.
Investigators also stated that Aguilar used DoorDash to obtain a Plan B emergency contraceptive and gave it to the girl. Surveillance footage from the dormitory reportedly shows Aguilar and the girl entering the room, and later the girl leaving.
Menlo College issued a statement acknowledging that it takes allegations of criminal conduct seriously and is cooperating with law enforcement. However, citing federal and state privacy laws and college policy, the institution declined to comment on Aguilar specifically. The college directed further inquiries to the Atherton Police Department.
San Mateo County District Attorney Steve Wagstaffe urged anyone who believes they may have been victimized by Aguilar to contact law enforcement. The district attorney's office is awaiting further evidence to decide on the possibility of additional charges.
