Lawrence Mayor Brian DePeña, 61, was arrested Friday on federal charges for allegedly misusing more than $1.5 million in COVID-19 Economic Injury Disaster Loans (EIDL). The funds were intended for small businesses impacted by the pandemic.
Prosecutors allege that DePeña applied for the funds to benefit his tire shop, Tenares Tire Services Inc., but instead used the money for his mayoral campaign and to pay personal debts. U.S. Attorney Leah B. Foley stated that DePeña "betrayed that trust through his alleged corruption and lies."
Following his arraignment, a video circulated widely on social media showing DePeña's lawyer speaking to reporters. When pressed for comment, the attorney stated, "He doesn’t speak English, no comment," while DePeña smiled and repeatedly said, "God bless you."
The exchange drew sharp criticism online, with many users questioning the mayor's ability to hold public office without speaking English. Conservative commentator and radio host Mike Gallagher posted on X, "‘He doesn’t speak English, no comment’ says the assistant of the mayor of an American city. Our melting pot has completely melted."
Social media users also posted a video that appeared to show the vehicle DePeña left in striking a parked car as it attempted to drive away.
DePeña was elected mayor of Lawrence in November 2021 and subsequently won re-election. He previously served on the Lawrence City Council from 2016 to 2021. If convicted of the charges, DePeña faces up to 30 years in prison.
Fox News Digital reached out to DePeña's office and his lawyer, Carlos Apostle, for comment.
